Actually, it's illegal either way. Generally speaking, a convicted felon cannot have access to or control over a gun at all.

The answer is, it depends on what you mean. There is a legal term "constructive possession" which includes intent and access. If a felon is found to have constructive intent, that is illegal. So, in short, if a felon gets into a vehicle with someone carrying a gun, that, in and of itself, it not illegal. If the felon intends to and can access the gun, that is illegal. The problem is, there is no exact definition of constructive intent, so penalties may or may not be enforced depending on the circumstances.

Another example might be, if a felon is driving along and his car breaks down in front of a gun store and he goes in just to use the phone to call a wrecker, that, in and of itself is not illegal. However, if he asks to look at guns while he is in there, that is illegal.

Yes. Being married to a felon does not mean the non-felon loses his or her rights. BUT, if the people live together, the guns must be kept where they are completely inaccessible to the felon. They must be either kept somewhere else, or they must be locked up where the felon CANNOT get to them.
