When the seatbelt fits properly around the person that is when you can ride in the front seat.

i would not recommend anyone under the age of 10 y.o

Legally a child over 5 years of age or 40 pounds can ride in the front seat in North Carolina. The state recommends though that children under 12 years of age ride in the back seat.
