In order to collect on her OWN insurance policy, she was required under Tennessee law to sue the other driver's insurance company. She asked her attorney to call the parents of the dead driver and tell them the lawsuit was a formality only (which it was) simply so she could collect on her own policy. She never took any money or property from them.

But make sure you have his correct address my suggestion is you send what is called a "DEMAND LETTER" by regular us mail and by certified mail "restricted delivery". its about $10.00 at the post office give him 30 days to pay. Dont worry if he dosent sign it just make sure you have his correct home address. Donot accept partial payment. DO NOT ACCEPT A CHECK. CASH OR MONEY ORDER ONLY. IN FULL> if he does not pay in 30 days file a small claims lawsuit against him in the local court nearest to his address. call the small claims court and ask questions. its easy simple and hopefully you will get your money. I am a realtor and signed a finders fee agreement with a builder on 3-30-2005. The builder agreed to pay me and my broker a 1% fee if my clients built and closed on a home within 2 years. My clients had a home built by this builder and closed on 10-24-05. When I talked with the builder to collect my fee he refused to pay, as I could not produce the signed agreement. I recently found the agreement, and he still refused to pay. I am considering filing a small claims suit to collect. The fee owed is $3,129, plus filing fees of $181.
