In most states the male would be considered a legal adult the female in all states is still a minor. States establish laws pertaining to relationships between minors and adults, including the age of consensual sex. Whether or not the adult male could find himself in legal difficulties depends upon the laws of the state and what the young lady's parents choose to do about the situation. However, the age of consent may inihibe the minor/major law part if both of you are consentent and if your girlfriend is over the age of consent, which is commonly 16.

In cases where charges are filed they are generally that of sexual misconduct or misdemeanor offenses. However, the adult should keep in mind that all states reserve the right to charge and prosecute any adult who violates existing laws that pertain to adult and minor relationships without the cooperation of the minor or the minor's parents or legal guardian.

The 18 year old SHOULD take responsibility of the child with the 16 yard old mom but the father almost always leaves them, the mom and the baby. (Which I think is just sad - in my opinion)
