it depends on the state and how far they are moving. for instance in oh a spouse can move the children anywhere within the state without a problem but if they then moved to another state the parent that did the move could be charged with kidnaping

I assume that you are asking about child custody. Generally, one parent cannot legally deprive the other parent of contact with their child. If the court is not already involved in this matter, contact the court (or an attorney who specializes in family law) for assistance.

If the court already has jurisdiction over the case through a divorce or custody action the parent who desires to move must obtain the permission of the court by seeking a modification of the custody/visitation order. The process will be much easier if the non-custodial parent consents. If they object the court will schedule a hearing and render a decision that is in the best interest of the child. A common reason for permitting the move is employment opportunuties.

She can. the father does not own her. the mother is her own person she can leave if she wishes, but will be better if taken to court

A person can move anywhere they like and they do not have to seek the permission of anyone else to do so. However if there are children involved and there is a disagreement over the amount of time one or the other of the parents can spent with the child then there are arbitrators or if that fails family courts available.
