My future husband is convicted of assault and battery of a child. can he get section 8 housing.

Probably not: felonies against children are often disqualifiers for the program. It is definitely a disqualifier if he has to register as a sex offender in his state. Even if not, this is considered a violent felony. However, every Housing Authority has its own rules regarding convicted felon eligibility. Under federal regulations HA's cannot admit registered sex offenders or those convicted of manufacture of methamphetamines.

Depends on type of felon: if one is a sex offender, drug or violent offender less than five years, or has a history of public assistance fraud, then he cannot receive assistance under Section 8.

Each Housing Authority has its own rules regarding felony convictions and living in a public housing unit or receiving a housing choice voucher. However, federal regulations prohibit certain felons from ever living in a public housing or receiving such a voucher. Sex offenders, violent offenders, and drug offenders of less than five years, are prohibited under federal guidelines from receiving a voucher or living in public housing.

Anyone can apply for Section 8. The question is really about the chances that a convicted felon will be approved for a Voucher. Every Housing Authority has its own rules regarding convicted felons' eligibility for their programs. However, under federal guidelines, registered sex offenders and those convicted of mfr. of methamphetamine are barred from eligibility.

It all depends on whether the felony is of violent nature, whether one must register as a sex offender, whether the felony is a drug violation, public assistance fraud, the crimes involved housing assistance or occurred on a public housing property or by someone with a voucher; these felonies and other felonies of less than five years from the last day of your prison sentence or probation, whichever occurs later, often permanently ban you from the voucher program. But many jurisdictions may have some exceptions to the rule except, under federal law, drug traffickers and registered sex offenders.

This depends on the felony or felonies the individual was convicted of and the age of that conviction. Each housing authority has its own right to make rules regarding the criteria for selection with regard to felony records. Normally, drug offenses are excluded as are other violent crimes, especially within the past five years of being released from prison or probation, whichever occurred later. Under federal law, anyone convicted of manufacturing methamphetamine or any sex offenses for which the individual must register as a sex offender, are automatically excluded from the voucher program or any other Housing Authority program. Some Housing Authorities will exclude drug and violent offenses regardless of the age of offense.

This depends on the age type of the offense. Each Housing Authority makes its own rule concerning felons convicted of drug offenses. However, under federal regulations, anyone convicted of manufacturing meth is permanently barred from the program. Most HA's don't admit drug felons of less than five years after the date of the felon's release from prison or other sanctions.
