No, the Mexican national will still have to get a Mexican passport. The US citizen will have to petition the husband in the USA (lots of paperwork) and wait for the appointment date, which may take several months. The appointment will be made in a US Consulate in Mexico and both spouses have to go. The spouse will have to get medical exams, fingerprints, photographs, etc, and they will indicate where you have to go get them done. Appointment may be in Monterrey, Piedras Negras or somewhere else. After the appointment and if the spouse is approved, he will get the legal documents to turn in at the US/Mexico border. This is a time consuming and costly procedure. Just because a person is a US citizien the spouse does not automatically get the green card or legal residency. It doesn't work like that any more. Especially after 911.

Yes. I married my wife, a Mexican citizen, in the US while living with her family in Mexico. She had a B1-B2 visa so she could legally enter the US. We returned to Mexico to live. It took 4 hrs including crossing the border. For us to get PERMISSION to marry in Mexico would have taken months.

Yes, there is no citizenship requirement for obtaining a marriage license in any U.S. State. There are, however, other requirements, such as minimum age and prohibitions against incestuous or polygamous marriages.

In most states of the U.S., parties to a marriage must be of opposite gender. In Mexico, same-sex couples can only be married in Mexico City, but that marriage is then recognized in all 31 Mexican states.

No. The US recognizes the marriage already performed in Mexico as valid. Therefore, an additional marriage could not take place without a divorce (or death).

If the ceremony were accidentally performed without anyone realizing that the person was already married, he/she could be prosecuted for bigamy and fraud, along with other crimes, and/or the second ceremony would be void and the US marriage would be invalid.

No. It is not possible for a person who is already legally married in Mexico to marry someone else in the United States unless they have obtained a divorce. The marriage in the US would be invalid because you can only be legally married to one person at a time in the United States. In addition, the person would need to lie on the application for marriage license. To knowingly lie on an application for a marriage license would constitute fraud.

Legally you can marry them in Mexico and then bring them back to the US. They are allowed to be in the US if they are married to a US Citizen.
