Most likely no. In the case of children of illegal immigrants, if a parent gets deported, they can either take the child or leave it to foster care until that child is 21 and can then petition for them. It was made abundantly clear in the 1898 US Supreme Court decision, US v Wong Kim Ark that any person born on US soil is born unto the rights entailed by US citizenry unless born unto foreign diplomats or hostile occupiers during time of war. The rules may be different for legal aliens. That I am unsure about. I hope this was helpful.

no, the baby will automatically become a citizen but the mom would not, she would have to be married to the father and he would have to go through all the proper steps and legal paperwork for the mom to become a permanent resident first and then 5 years later you can apply for citizenship if you are accepted to be a permanent resident first. after first filing with the Immigration service, it takes at least 2 years for an interview which takes place at the Mexican counselate which is in Mexico. and by the way you need to go back to Mexico while your husband would file your paperwork. and when it comes time for the interview,good luck on being accepted as a permanent resident because they will have proof that you were in the US illegallly because of the baby and so they usually will make you then file a pardon for being in the US illegallly and that takes another 6 months until they hopefully pardon you

Though it is very complicated, illegal immigrants can not become legal if they have children in the US. However, children born in the United States have natural born citizenship. The parent(s) can not be deported back to their country of origin due to the children being legal citizens. Their country of origin is the US.

Since this is the case, by the time the children become of age, the illegal parent(s) may try for citizenship of the state that they live in. *however this is just as complex because different states require people to live in that state for their certain number of years before applying for such citizenship
