They can only garnish your wages if they took you to court and a judge ordered the garnishment via a judgement. The lender first off must be licensed to be able to take action against you in court. But the only entity who can garnish your wages without a court order is the federal government. No matter what you signed there must be due process. Hope this helps.

What do you mean "illegal"? If you signed a promissory note, and did not fulfill your end of the bargain, that individual or company can sue you. If you do not show up to defend yourself, they will get a default judgment and can garnish your wages.

In Indiana, a credit card company can only garnish wages if there has been a judgment against you. If they sued you, and you lost or did not show, and the Judge determined you owed, they can garnish you. They can not do it on their own.
