No. Sperm in itself will not give you herpes. However, the position you put yourself in that gave you access to that sperm is a different story all together. In other words, if you gave oral sex to your partner who has herpes, then you are putting yourself at risk of contracting the disease yourself. Use protection, either a condom or dam. The risk can be very high if nothing is used.

assuming you had oral sex to swallow the sperm and you are not just drinking from a cup you could get HPV, HIV, chlamydia, Hepatitis A, Hepatitis B, gonorrhea. A: But only if the guy you are sucking has any of those things in the first place. And I know that with HIV the chance of contracting it orally is MUCH lower than if you had unprotected anal sex (the riskiest) or vaginal sex (the second riskiest) with him. Its also important that the risk of getting any of those comes from just sucking the penis. The risk is lower if you don't let him ejaculate in your mouth, but there is still a risk because they can be spread through the pre-cum that oozes out while you suck him. But if you let him ejaculate in your mouth anyway, then you have already been exposed and there is no further risk in swallowing the sperm because they will not survive in the stomachs acid.
