If the person was married previously and did not obtain a legal dissolution of that marriage (divorce) the second marriage is not legal. If the couple filed taxes or entered into other contracts or legal matters as a married couple there could be serious consequences. The best option is to consult with legal counsel before the situation becomes more complicated.

First, he can't marry you legally until he is legally divorced from the other wife. Second, any man that is married to someone else and is suggesting marriage to you - is someone you cannot trust. Tell this guy to come back and see you when he has a signed divorce decree in his hand.

If you discover that your "husband" is still married to another woman - which is bigamy, then your marriage is not legal and he has broken the law. Bigamy is subject to fines and or jail time. The first thing you do before you even discuss it with him is take all of your own assets out of joint use. Close checking accounts and credit cards that have his name on them either as primary card holder or authorized user. Open new accounts at different banks and card companies in your name only so that he does not have the opportunity to drain your assets. Then turn him in. He is not an honorable man, he can not be trusted and you can do better. Don't stand by him. Remember his real wife and run the other way as fast as you can.

No. In the Unites States and all other Western countries a person can only be married to one person at a time. If you married a man who is already married your "marriage" would be null and void and he would be violating the law. If he died his wife would inherit his property and would also be considered his next of kin if something happened to him.

You can't. In the United States you can only be married to one person at a time. Although many countries allow men to have multiple wives, none allow women to have multiple husbands.

A person who is married and who knowingly marries another person without legally dissolving their first marriage commits the crime of bigamy.

In your case, you're not married. Generally, in Western cultures you can only be legally married to one person at a time. If your partner was already married when they married you then your marriage is invalid and of no effect. Your partner is still legally married to their first spouse until they obtain a legal divorce.

The married person would be committing the criminal act of bigamy, which in most states is considered a lower class of felony. The second marriage would not be considered legal.
