  • This is Canadian Law: An employer cannot fire an employee if they are ill and when that employee returns to work they can change jobs in the company where they can cope. If you quit a job then the employer has no responsibility towards that employee.

It depends on many factors and state laws. Generally when you quit or get fired there is an adjudication hearing and you are able to tell your side of the story. Usually if you quit due to a medical condition and you have documentation from a Doctor stating that they advised you to quit your job, you will be granted unemployment. If you quit for a medical condition that prevents you from working, then you will probably be denied because you are "unable to work." To be eligible for benefits one must be "able and available to seek and accept IMMEDIATE full time work."

You might be able to apply for disability if the issue has been going on for awhile. Check with Social Security (this is different from retirement) and with your HR to see if there is any short term disability available. Unemployment is for layoff or involuntary leaving of a job.

In general, no. You must be unemployed through no fault of your own, able to work and be seeking work. However, you MAY be eligible for disability insurance coverage.
