If a married person had intercourse with another, out of marriage, It would not be illegal. It would just be grounds for divorce and some amount of the people involved would be emotionally hurt.

Whereas, if person openly admitted that they loved two or more people and they each agreed to be married, it would be illegal for them to be married.

They are seldom prosecuted unless of a fraudulent scheme to get property or money from another or some other felony.

This depends on the state. In some states you may not get any jail time, just a fine. In other states you can be in jail for 5 years.
