One attorney's adviceI live in Texas, and recently became engaged to a Mexican woman (undocumented). The truth is, this woman and I love each other and intend to live together for the rest of our lives. Please understand this is not a "marriage of convenience". We consulted with an Immigration attorney who told us that just getting married would NOT change her immigration status, and that she would still be subject to deportation just as before. The attorney advised us to wait and see if recently proposed legislation would allow her status to be changed to allow her to stay and work legally, since she has been living in the U.S. for more than five years. In other words, our only option is for her to remain illegal until the law changes.

My fiance is a bilingual teacher and a wonderful, caring woman. If anyone else in Texas has any further information, please respond to this posting. We are desperately searching for a way to make this work legally.

Can a legal alien marry an alien?

If by "legal alien" you mean a "resident alien" (i.e., a foreigner with permission to live in the United States) and by "alien" you mean any alien, whether legal or illegal (undocumented), then the answer is yes. Generally, there is no citizenship requirement for marriage in the United States. What effect the marriage will have on the immigration status of the parties involved is another question.

Do you need to get a divorce if your husband was illegal?

It seems that you are asking about your marriage to an undocumented immigrant (a/k/a an illegal alien). The lack of a legal immigration status has no effect on the validity of a marriage. Persons illegally present in the United States can marry citizens, or marry other undocumented immigrants, and their marriages are perfectly legal. If you married a foreigner (whether he has a visa, a green care or neither) then you remain legally married to him (even if he returns to his country) and you may not marry again unless you first obtain a legal divorce.

Can an undocumented immigrant use a matricula consular id to marry someone of the same sex?

How does an illegal marry someone who is legal?

Being an undocumented alien is a statutory tort against the state, the remedy for which could be removal from the country, which could make it difficult or impossible to cohabitate with your spouse. However, if you prove the marriage is genuine for the purposes of immigration law, you may be able to use that as a basis to apply for a visa, although as an undocumented alien you may have to apply from outside the country. Such a marriage will be investigated by the USCIS to be sure it is not a sham being used solely to remain in the country. It is a federal crime to use the existence of or proof of a marriage which was entered into solely to support an attempt to obtain a visa to support an application for a visa, and not for the lawful reasons to enter into a marriage. Your status as an undocumented alien is distinct from your capacity to marry. You need only have the capacity and the desire to get married. A State court judge or magistrate can perform a civil ceremony, after which you have to obtain a marriage license or certificate. Clerics are also authorized by the State to solemnize marriages.

Can a permanent resident marry an undocumented alien and grant them residency?

you can marry but it is no guarantee if they will become legal. You need to understand even if children are involved you are looking at time and money. if your spouse entered the country illegally they will have to return to their homeland at some point of the process (unless the laws change) and then depending on how long they have been in the u.s illegally, they have the option of denying them re-entry for up to 10 years. You need to know this.

If you are on public assistance can you marry an undocumented immigrant?

It is not smart to marry an undocumented immigrant in the first place. If our government finds out, yes, your public assistance and a lot more will be taken away. In fact, you having public assistance and marrying an illegal can cause a magnifying glass to be over you, which puts you more at risk.
