In California, it is illegal to operate any vehicle while wearing earbuds or headphones of any kind, except for a bluetooth cellphone earpiece. CA Vehicle Code sect. 27400. It is a non-moving violation, which means that if you get stopped, you will get a ticket to pay a fine, but will not get a blackmark on your driving record or increased insurance. I don't know what the laws are in other states on this, however.
