Ring the Dept for chid Protective Services and ask for relevant forms. They will also let u know of family court forms u need to submit. There is alot involved and some legal advice or a lawyer would help. It is a lenghthly process and they say almost impossible if the bio father(or sperm donor as i like to call it) wont consent. i am currently going through the process myself. best of luck to u and yr family.

Answer . You need legal counsel for this one. You should have no problem at all since the biological father terminated his rights as the father of that child. Do it legal s…o there is no chance of further trouble from the biological father. Termination of rights to his child doesn't mean much if he lets a few years slip by and can convince a judge that he was too young at the time, but has now matured and would like to be part of his child's life. A judge may very well grant him his wish and it's trouble for you!
Either the biological father has to sign away his rights as a parent, or you can go to an adoption attorney and take that route. If the biological is not active in the child's… life, it may be fairly simple. If he is active, the biological can fight for his rights and you will probably end up in court. My husband and I went through this and are going through the phase that I hear most people go through who do legal adoptions. Our children have sought out the biological and he(the biological) is reaking havok on our household-its terrible, so just understand the process and the consequence of your loving action. It can come back to bite you later-possibly, not always. Remember kids always think the grass is greener on the other side. Best of luck though.
Would you be able to file a termination of rights of the father if there is another man who wants to adopt your child even if your child considers the man her father but knows biologically he is not?
Most likely all though if the child is over the age of 14 it would be extremely dificult or impossible
After a child is legally adopted by his stepfather can a biological father claim any rights to the child?
A child can only have two legal guardians, meaning the biological father would have to either give up his rights voluntarily or lose them through the court system in order… for the stepfather to adopt the child.
if she puts it up for adoption or u marry her- if you adopt your girlfriends child that means she must give her to an adoption center- so unless she did that- no --…-oh and besides- its impossible not to have a father
In the state of Massachusetts if a biological father is unaware of a child and the child is adopted by his stepfather is the bio dad responsible for any back child support?
Well if the Bio father is unaware of the baby then I don't believe he has to pay child support because the mom decided that the father didn't need to know about the child and …if the child is adopted (like me) either by a step dad or by a different set of parent AND the father know about the child Then the father would need to pay back child support.
The only way that parental rights will be terminated is if both parents and the family court agree that it is in the best interest of the child to terminate them. Simply… wishing to stop being responsible for child support typically is not sufficient reason to terminate because it leaves the child in the position of not being cared for financially. Adoptive parents become natural parents with all the rights and responsibilities that entails the moment the adoption papers are finalized.
If the biological father is deceased and the child has been removed from bio mom by social services will the child go to the stepfather who wants custody?
Long as he is the immediate next of kin who is physically and mentally able to take care of the child. Also he has to be the only one who wants him/her.
Laws vary from state to state, but in most cases a person can only sign off rights to a child if antoher party, for example a step father was willing to adopt.
The biological father may only stop paying child support under one of the following four circumstances: Death of the child; the child turns 18 and decides not to pursue hi…gher education; the child quits or graduates higher education; or the biological father is found not to be the "true" father. So, if a stepfather adopts them, more than likely, the biological will still be responsible for child support.
How does a father who has custody of a child divorce and leave the child with the step mom child wants to be with bio mom child is 17?
Mother files motion for custody
If you are already married to the child's mother and everyone is living together as a family unit, it probably is not diffcult to do so. File the papers at your local Clerk Of… Court office.
Can bio-mother add step father to birth certificate without notifying biological father and step father not adopted child?
no, changing the birth certificate requires adoption, and can only be done if the birth father's parental rights have been terminated.
they should because the stepfather is the dad not the bio father
No, in order to adopt someone elses child the parent have to give up their parental rights or the court have to take it from him.
Yes as long as the stepfather and mother are married for a year and if everyone in the equation agrees to the adopting.
You have to show due diligence in trying to track down the father. This isn't a DiY project, you should speak to an attorney in your area who can assist you through this proce…ss. If you're adopting through the state, you need to be aggressive in making sure that the case worker has done this due diligence. There would be a hearing to terminate the parental rights of the unknown father. Something like the article in the related links would need to be posted for legal reasons. But again, this isn't a DiY project; talk to an attorney and/or your case worker.
