You might have to return to court to make sure the withholding stops, but this need not involve the hiring of an attorney.

Is the father still responsible for child support even if the court papers say he's not?

Legally, it would depend on the exact legislation. Morally, almost certainly

How do we collect back child support from my ex husband's estate?

The exact procedure depends on your state of residence, but generally, if there are assets in the deceased parent's estate, they will be filed in the probate court in his county of residence and you will need to file a claim for diversion of assets. You should consult an attorney, a child support advocate or the clerk of the family and/or probate court.

Does child support payments stop after the child graduates high school?

The only time child support stops is when the child turns 18 and it is paid in full with no back child support owed. If there is any child support owed however it still can be collected even if the child is 18 and out of school. The only other way child support may stop is if there is also an adoption even then if there is support owed before the adoption they still get that money. This is all of course if you have a child support order through the courts or it's in a divorce decree.

What are the consequences for a father who doesn't pay child support?

Laws differ between states. If the support is court ordered, then he can lose his drivers license and/or be put in jail. He MUST pay the court ordered amount and if he doesn't make enough, he needs to get another job. Most states can attach his wages. Remarriage has no bearing on child support. But will have on spousal support. Laws differ between states. If the support is court ordered, then he can lose his drivers license and/or be put in jail. How is a person notified that they will have to pay child support?

Exact notification procedures may vary by state, but you will receive a document from the child support agency or family court in your county of residence in the mail (regular or certified post depending on your state's laws) at your last known legal address, delivered by the sheriff, or failing that, at your place of employment.

Do you have to pay support if child misses semester of college?

The time frame is probably longer than that--indicating that they have left school. A semester out of school may be just a break. If you're "just curious", that's probably a good enough answer. If you have some financial stake in the answer, though, consult a lawyer, because it will depend on your location and the exact wording of the support decree.

Can a mother need permission from the father to take child out of state if paying child support?

If there is a custody order involving the child (and if child support is involved, there almost certainly will be), the parent who wants to take the child out of state should get the approval of the other parent. If the other parent will not agree, then there is always the option of going back to the court that issued the custody order to get permission from the court. (Depending on the exact terms of the custody order you may need to do this even if you have the other parent's approval, but having the other parent's approval will generally make the process much smoother.)

How do you file abandonment charges on a father who does not pay child support and does not have anything to do with the child?

The process for filing abandonment charges on a noncustodial father who doesn't pay support varies by state. Generally speaking, if he has not seen the child for at least six months, you can file abandonment charges in family court.

My sister let my 16 year old daughter move into her house in Missouri without my consent she is receiving state aide trying to make me pay child support How is this possible?

It shouldn't be. In order for her to do that she would have to have custody of the child, which would have involved going to court or at least a lawyer. The only way she might be able to get away with it is if she has been living there for a while and your sister tries to argue that she is paying for all the child's expenses and therefor her guardian. You should be able to talk to someone at the county courthouse or at child services to get exact information for where you are at. Either way she will have to take you to court to get the child support from you.

You have custody of your children but your ex husband claims them on his tax return can you change this in court?

You do not have to surrender the taxes and you do not have to go to court. The new IRS law mandates that the custodial parent is the one who is awarded the tax return, regardless. Unless you have a divorce degree that specifically states the exact dates for release of tax to the non-custodial parent AND it was signed before 1983 or 1984 (I can't remember the exact year) then no state court in the country with a decree can over ride it. YOU get the tax return. Someone somewhere saw the nonsense of the non-custodial parent taking money away from their children.I suggest you look up the IRS law on line and send it to your ex. Beware, however. In my case, my ex decided to take his greed out of the child support when he couldn't get the kid's tax returns. But that's easy to fix. Child recovery services has no tolerance for dead-beat dads. You never have to even contact him. Just go to your state child support services and they do all the research on his wages; what he owes, all back child support, even money he's made on the side such as bonuses, Christmas bonuses, and any rental properties, etc. They will take it right out of his tax returns and then write you a check. If he has no tax return coming, they will garnish his wages up front. From that point on, you receive a check from your child support recovery service, not your ex. They just take the money before he even sees it. So really, if he's not up on his child support, you may get all of the credit for your children, yourself, and even your ex's return.

Can a custodial parent get in trouble if that parent leaves the country for vacation and leaves minor child with step dad?

It depends on the exact language in the custody decree, but ordinarily a custodial parent is allowed to place a minor child in the temporary care of any responsible adult.
