∙ 11y agoI consulted with several "officials" in a number of government branches and while there have been attempts to lump tattoo's and body piercing into a license defined as 'Cosmetology' - those bills failed. The officials told me that no license is required to perform tattoo's in Maryland (I only do tats, no piercings), but if any complaints are filed - that shop will be subject to health department inspections. I prefer to stay straight and fly right, keep everything very sterile (maybe exceeding hospital standards most times), pay my income and sales and use taxes, etc. If the health department inspects my shop - I'd like to think they'd learn something. LOL.

∙ 12y agoIn the state of Virginia, it is unlawful to tattoo any person under the age of 18 without proper parental consent, i.e.; both of your parents present at the time of paperwork completion, their state issued ID's, a copy of your birth certificate, and both parents must be present throughout the duration of the tattoo. If you do not have the consent of your parents and the aforementioned items, you must then wait till 18 years of age.

∙ 12y agoIn the state of Virginia, a "Tattoo License" is not required, at least not yet. Additionally, in the state of Virginia, it is illegal to tattoo any person under the age of 18 unless they have proper parental consent and that BOTH of the parents of the minor are present for paperwork completion and for the duration of the tattoo. If you tattoo the minor without this requirement, you will be subject to a Class 2 Misdemeanor and upwards of a $500.00 fine. If you were to tattoo the aforementioned minor without the requirement of the parental permission along with not taking the proper sterilization techniques and using barrier film and Single Use needles, they will upgrade your Class 2 to a Class 1 Misdemeanor and you will be surely looking at some jail time and they will bump up the fine to more like $1,000.00. Additionally, if the state or the parents were to want to really stick it to you, I have heard of artists (both professional and otherwise) being hit with Statutory Rape charges. These usually don't stick of course, but you are illegally penetrating a minor at the end of the day, so it's not completely a smear job on you. Lastly, not that yours is one of them, but there are states within our country that deem tattooing a fairly medical procedure, so if you are tattooing without proper training and credits they can and WILL hit you for "Performing Surgery Without a License", which is met with a maximum fine of $25,000.00 and jail time.
