In a country which uses civil law, the legal system is based upon legal principles and codes usually rooted from the laws and legal system of the Roman Empire. Any updates to the legal code must be made through legislation or other lengthy processes. Furthermore, judges must make rulings based only on these codes. On the other hand, a country which uses anglo-saxon based common law has a legal system based upon past judicial opinions. Thus, common law systems acquire their laws over time and may have their laws altered by single rulings.

Roman law not a civil law sytem. It went beyond the area of civil law. Civil law is a branch of law which is distinguished from the criminal law branch and administrative law branch. It pertains to dealings between private individuals and covers matters such as property, contracts, inheritance and the like. The Roman legal system included civil, criminal and administrative law.

In Roman law, civil law was the body of laws specific to a people, established and followed by a that people. The law of nations (ius gentium) was the common law of all mankind, the law which natural reason established among all peoples alike and a law which is followed by all mankind. It was a law innate in every man and which had a higher moral obligation binding all men beyond the civil laws of particular peoples. Thus, the law of nations applied to the dealings between Romans and non-Romans

Ius gentium covered wars, national interests, sovereignty, property rights and boundaries, treaties and trade. The praetor peregrinos was a chief justice who administered justice among foreigners. He arbitrated disputes between Roman citizens and foreign citizens or among foreigners within the Roman Empire. This office was instituted with the increase in trade with foreign peoples. This official adjudicated cases on the basis of Roman law, thus making Roman law applicable to all peoples who had interactions with the Romans.
