If you are the child's father then you really have little legal support to not support your child. Your child is legally entitled to your financial support.

Do fathers have legitimate reasons for refusing to pay child support?

some may sometimes. i am a child of divorced parents and my father makes more than my mom and still tries to fight paying child support. in his case no he has no legitimate reason. i think if a father is trying to fight paying his child support he should be thuroughly investigated as to why he believes he should be exempt from supporting the child he helped to create and is now leaving all responsibility with the mother.

What do you do when one parent wants to give the baby away but the other does not?

If it is the mother of the child that wants to keep the baby then most mothers would not let anything stand in the way of the child and herself. In this case she can tell the father to leave, but he will be paying child support. If it's the father that wants to keep the child then he has a chance to fight it in court and should seek legal counsel.

In ny state if a father neglects to file an objection to a child support order based on his default is he able to request another court date to overturn the verdict If so how could I fight that?

The father may be able to fight against the child support order by showing that his circumstances have changed. You simply need to request the proof of this change, and crunch the numbers based on your state's child support formula.

What do you do if you get child support papers and know your not the father of the child?

Ask for a paternity test. Most states require that one is taken to ensure the father is the one who the mother said he is. If your state does not require a paternity test, then I would suggest paying for one out of pocket so that you can take the results to the court hearing. If you are not the father and there are papers stating that there is a hearing then you should be able to fight the hearing and the paperwork.

How do you stop child support payments if the mother doesn't allow the father to see the child based on the visitation arrangements and trashes the father on the internet?

You don't, you fight it. Let me teach you how. see links below

Do you need to get full custody if no paternity is established and you have no child support and have not had any contact for almost a year with him?

As long as you have not named this young man on the birth certificate of your child, then you have every right to continue to look after your daughter as a single parent. If you have named this young man on the birth certificate and he has decided to fight you for this child (or hasn't said a word yet) it is best you get sole custody and be sure the courts realize he has been an unsupportive father and has not paid child support. If he has been paying child support and neither of you have custody this could be a problem and he may fight you in court for his rights. After establishing paternity a biological father can petition the court for custodial or visitation privileges regardless if he has been placed on the birth certificate. The child support issue will only be addressed after such action has been implemented or if the birth mother files for support or public assistance.

If a child support lien is in place can it be removed if paternity test shows that you are not the father?

YES ... but if you sighed the berth certificate then you' ll have a fight on your hands the court will see it as you recognizing that you took up the responsibility of raising the child and there for must pay in the up keep of the child... Liens are placed to collect unpaid, past-due support. It is likely that you will still owe that unpaid support even if/when the courts determine that you are not the father.

What can you do if you cannot afford an attorney and you want to fight for custody of your child?

If a father is able and available to care for his own son due to the fact that he is a seasonal worker, can the mother petitioned the courts for the father to continue paying child support, does daycare supersede the bonding between a father and a son? She legally cannot keep you from your children. But they do it all the time. Contact the courts and apply for a legal aid which will represent you for free. But first contact your human services where you pay your child support. They can't really do much, but sometimes a call to the mother from them explaining that she is in contempt of court will scare her RIGHT. Trust me , it happened with my husband and his ex because I would't provide their daughter with my insurance. Child support and visitation are two different things.

Can the mother of a child tell the father of the child that he can only visit his kid after a certain time without a court order?

No, the father should have rights to visit the child. but the dates and times should be up to you . :) But, single fathers have not legal rights to see their children, even while paying child support, until granted those rights by the court. I teach fathers how to fight for their rights. It's a Glass Ceiling thing, only the father is in the subbasement with the base level, and twp layers of 12-inch thick temper glass to break through to reach the mother's level.

If a mother does not want child support can the father see his child?

You will still have to pay back if any owed. After you sign you won't have to pay anymore because all your legal rights to the child will be terminiated. If Mom agrees to let you voluntarily terminate your parental rights, then, no, you won't have to pay child support going forward (but will still have to pay any arrearage unless Mom agrees to forgive it). But DO NOT do this if it not what you want to do. If you want to be a father, fight for it. Get court ordered visitation, then if Mom refuses to allow you to see your child, she can be held in contempt of court.

Can child support be used to pay ex wife's car payment?

Yes, she provides transportation for your child. It can pay her rent, her house payment, her utility bills or anything else she sees fit. If your child is being neglected you can fight for custody, and present your side. Otherwise what she does with the child support is not your business. Sad but true, sit in family court for a day, this argument happens all to often, and the paying parent never wins.

Can a grandmother fight to get support from the father if she doesn't have custody?

Absolutely, you can fight for it. If the child is living with you, then you need to talk to an attorney about getting child support and maybe even custody of the child. I know there have been many cases where the grandmother, being the one the child lives with, has received child support, even if she doesn't have legal custody. She is still the one raising and supporting the child. This may vary from state to state, so you need to talk to an attorney about your situation. He or she will be able to advise you of your rights, and will let you know if they feel you have a good case. And, quite often, they will not charge you for the initial consultation, or only a very small fee. So if you are raising your grandchild with no financial support from either parent, you owe it to yourself and the child to try to get financial support.
