Generally if it is likely to be copyrighted by a major broadcaster such as the BBC/ITV/etc then it is likely illegal as your are breaching copy-right regulations

The victim is the owner of the music (usually the recording company, or the artist). Illegally downloading music is stealing, because you are taking something that is not yours without paying for it or permission.

If you are downloading music fraudulently from the iTunes store then they may find you. If you have illegally downloaded music from elsewhere then iTunes will not know about it.
