In the United States, the power for the Judicial Branch comes explicitly from the Constitution, where Article III spells out the powers of the Judicial Branch.

The structure of the US Judicial Branch is solely at the discretion of the Legislature to define. The only mention in the Constitution is that there be ONE Supreme Court with other courts. How we currently organize the court system has been defined by legislation, not by any original document.
