You should follow the following path
1: In File menu go to Export Page
2: A dialogue Box Open click on Browse
3: Give File Name
4: In Save as Type change the properties Encapsulated Post Script File (EPS)
5: Click on Save
6: In opened dialogue box select your desired option for 1 page of more than one page or selected page
7: Click on Save than click OK.

Basically what PS is saying is : I see that this is a eps file but the data in the file tells me it isn't. Then Photoshop gets all mad and doesn't want to play with you anymore.
