depends on if they changed lanes safely or not(used their turn signals and changed lanes when safe to do so ) If they did you are At Fault , if not they are . ALLWAYS get a cop out on the scene of a traffic accident , get a report and request that they be cited(given a ticket ) if they illegally change lanes etc , that way you have placed the blame where it should be and had it verified by an independent party (the police) , which is a tough combo to beat in a claim or in court . Good luck
The other person is at fault. The law looks at this in the following way: they should have given themselves enough room behind you for them to be able to stop. If you were able to stop so quickly then they should have also been able to stop quickly; you must drive with adequate space.
Given just these facts, the only person at fault is the one who hit you from behind. They or their insurance are responsible for all resulting damage and injuries. Make them pay.
Yes, the person driving the car that rear ends the person in front of them is at fault. If this happens, make sure to swap insurance information so the damage will be covered.
The one who crossed lanes. As in driving without due care and attention, reckless endangerment, assault with a motor vehicle etc,.
As long as you were stopped the recommended distance for your area behind the car you hit, then it should be the original person's fault (the one who hits you).
That is called cutting someone off
sad
If they backed into you, it's their fault. Failure to yield.
I believe it could be both persons fault. If you're driving and someone decides to jump in front of your car it's not you fault. If you're driving and aren't being careful or just can't stop in time, than it's your fault. -Bobbbbbbbbbbbbbbbbb
Yes, it probably would. If you changed lanes and you bump in to someone in front of you, you were not looking. The same for if you bumped into someone behind you.
First, you shouldn't be cutting people off. Whom ever hit the other car from behind would be at fault.
It depends on who had right of way.
Anyone who hits someone from behind is at fault. Even though it may seem like the driver in front shouldn't have done what they did.
Each car has a duty of care to survail the road in front of them. No, if you couldn't avoid the accident due to a sudden emergency or someone cutting you off or stopping for no reason in front of you, or yes, if you were both at fault for being on cell phones, eating, or talking to someone in the car and not paying any attention. Basically, the person who has the last clear chance to avoid the accident, but doesn't has to take the blame.
Their fault for not looking both ways
you are... by law, its tish enit
possibly my front will be bleeding
