Maybe. Depends on where they live. In CA he is considered an adult male and she is a minor, so yes he could be charged with rape of a minor. In other states the age of consent is 16 so the answer is no. One or two states have the age of consent as 21 so the answer would be yes for those states.

In some places it's considered rape just because of your age and his, no matter what you say. But usually charges have to be pressed for that to happen.
