If the father of a child gets married and owes back child support can the new spouse be obligated to pay his back child support in the state of Texas?
Usually no, but unfortunalty some states consider a husband and wife equally responsible for each others mistakes. Find out if Texas is one of them. I forget the technical nam…e of it, sorry.
In the state of Texas does a father have to pay back child support if he gives up his rights to a child?
As you have now given up your rights to the child you do not have to pay back child support.
In Texas, when the child graduates from High School. So if you have more then one child, when the last child that you have graduates from High School is when the child s…upport payments will end for you. If the child is not in school for whatever reason it is the age of 18 years old.
according to Judge David Grey Ross, Commissioner of the Federal Office of Child Support Enforcement, no. Nor can arrears accumulate.
Retroactive is 5 years. Arrears, there is none under federal law, but the obligee must maintain the claim.
If child support hasn't been ordered and the child is now 14 how far back can the courts go to make you pay back child support in Texas.?
Five years, unless the mother was on welfare. see link
The AG will handle that.
Until they and the interest penalties are paid.
Yes, depending on the amount of arrears, and circumstances. The term "Back Child Support" is usually not unpaid, but rather a retroactive order, often for a child the man neve…r knew existed. Under these grounds, even with tens of thousands owing, a judge can still clear the way to obtain a passport. The intent of the law was to address someone leaving the country with the intent to avoid paying an already established order that has fallen into arrears. In this economy, there are fewer countries not willing to enforce a foreign order as they attach a surcharge to the process. see links below
That should be in the paperwork that was included in the order. In any case, DO NOT PAY the other parent directly - send your payments to the court or the State Disbursement U…nit.
I suggest that you contact your State's child support agency. When you get an interview with them, bring all the papers relating to your child support: birth certificates, a…cknowledgments of paternity, court orders, payment records, etc. Be polite but persistent. Good luck!
Can your ex spouse sue you for child support after your son turns 18 and has graduated from highschool All child support payments have been made and there is no back child support due?
Your ex might be looking for support during college. In some States, parental responsibility extends beyond age 18, even if the child is no longer in school. Also, support oft…en continues into adulthood for severely disabled children.
You can't fully relinquish your rights until that back child support is paid. So you have to either pay it first or the custodial parent voluntarily waives it.
Absolutely. If they did not it would be common for noncustodial parents to slack off and not pay at all. It is not fair to the child.
yes. your obligated to pay support until your financial obligation is met in full regardless of how old the child is. I know people with children in their mid-20s still paying… the other parent child support that is in arrears
