The biggest difference is who brings the lawsuit, and the types of punishments.

In criminal law, prosecution is by the govt (state or federal). Punishments may be fines (paid to the govt) or jail.

In tort law, the plaintiff who brings the suit is the person who was directly injured -- and the punishment is usually payment of monetary damages to the person injured.

Another difference is that in most legal systems -- crimes are defined by statute, where as torts mostly exist based on past cases (precedent) that established them.This is most often in common law systems, like we have in the US and England.

There are two types of criminal acts (generally speaking): malum in se and malum prohibitum. A malum in se offense is a criminal act that is criminal because it is a moral wrong, such as murder, theft, rape, etc. All major malum in se offenses can be brought up as torts as well. (In the case of murder, the estate can sue for damages; in the case of theft, the victim can sue for stolen property and/or money; in the case of rape, the victim can sue for medical expenses and psychiatric help, etc.) A malum prohibitum offense is a criminal act that is criminal because of regulatory activity, such as blue laws banning the purchase of alcohol on Sundays, not paying the parking meter, or selling food without governmental certification. Many malum prohibitum offenses are torts (such as selling "tainted" foods), but some, like selling alcohol in contravention to blue laws, are criminal acts that are not also tortious.

A 'tort" is a CIVIL wrong. No criminality is attached to it. If the act was criminal there would be no civil action.

Civil law and criminal law do not overlap.

Think the O.J. Simpson case. He was charged criminally - found not guilty. Only then was he sued civilly - and found guilty.

Tort law is different from criminal law in that: (1) torts may result from negligent but not intentional or criminal actions and (2) tort lawsuits have a lower burden of proof such as preponderance of evidence rather than beyond a reasonable doubt.

There is some overlap between criminal law and tort law. For example an assault may be both a crime and a tort.

So while a tort is not a criminal act, an act may be both a tort and a crime.
