Perhaps the two following laws on the books in Cali can be of assistance. "Marijuana means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds, or resin. It does not include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks (except the resin extracted therefrom), fiber, oil, or cake, or the sterilized seed of the plant which is incapable of germination." California Health & Safety Code 11018. Sale, transportation or distribution of marijuana is a felony under Health and Safety Code Sections 11360. Transporting or giving away (furnishing) one ounce or less is a misdemeanor punishable by a maximum $100 fine. So I would say that, in my opinion, seeds are illegal to posses in Cali, but depending on the cop, you would either get written up for a misdemeanor or a stern warning. However, if you order them from outside the country, you are now involving the Feds, and they might either just confiscate the package and send you a letter( no further action taken), or they can be dicks about it and try and bust you in varying degrees.... from a small fine to possible confiscation of personal property and real estate, although I think the latter would only be for career criminals or those with intent to cultivate for sale.

It is actually quite legal to obtain, possess or even raise medical marijuana in California and has been since 1996.

The so-called Compassionate Use Act allows for the seriously or chronically ill to attempt to treat their ailments with cannabis (marijuana) so long as it has been recommended by a physician. This act did not legalize marijuana cultivation, use or sales by the general public or without the advice of a doctor. It does include wording that allows patients or their primary caregiver to obtain, cultivate and possess cannabis for their own medicinal needs.

The Compassionate Use Act, also known as Health and Safety Code 11362.5, legalized the controlled use of medical marijuana. California still does not allow any citizen the right to use or grow cannabis without reason. Remember, the ordinance contains the following provisions:

  • It protects the rights of the "seriously ill" to use cannabis medicinally
  • The law does not condone nonmedical uses of marijuana
  • Written or oral direction of a physician is required

It should also be remembered that this is a California state law and does not affect in any way the statutes or regulations of any other state. The Compassionate Use Act does not supercede Federal Laws.

If what you mean is growing Pot legal...absolutely not. It is a much more serious offense than possession. Cultivation charges are generally considered similar to distribution...even if only a few plants.

Proposition 215 was passed in California a while ago, this act allows patients that have a doctors reccomendation to use and cultivate marijuana. So yes, it is legal to grow marijuana in California, but the amount if plants allowed is limited.

in california if you get a medical marijuana licence you are aloud to smoke it or have up to 8 oz on you or grow up to 15 plants you cant grow if you dont have one, but its not totaly legal if you get caught selling it you can go to prison and even the cops can shut down the shops that sell it if they wanted to..i plan on going to cali to grow it i dont smoke it but the feild there is worth it my friend just moved there and he already has made more money there than he has working for the last 7 years not to brag but he has made 1.7 million in just a year and a half thats with him growing year round... :) but like i said thoe you can get busted and all of your stuff will be take and you get no money back so if you live there give it a shot but if you live in a differnt state and want to go there to try it out make sure you got the money and sum cause if you put your last dollar into it then you get in truble your screwed so make sure you get a licence and then you should be all right just follow the law,, but please dont take this as helpful info its justa heads up i can get into truble for putting this up here but one hand washes the other the law looks at this as if i was to be telling you there info witch is stupid if you need more info please comment and ill say more thanks

There is a gray are in this legal matter as of now. My attorney told me that you can "legally" grow up to 99 plants before the Feds step in, and that's with a regular Physician's License, not the special "Growers License". In fact, you can grow the amount you need to consume. Some patients need a lot more than others. I found a lot of information on NORML's website.
