Yes, it is. Oregon law states that all persons riding in a motor vehicle such as a car or truck must be wearing seatbelts whenever the vehicle is in motion.

The following exceptions are made:

people 18 and older; minors secured with a safety belt or harness; parades; minors seated on the floor of the open bed of a motor vehicle in which all available passenger seats are occupied by minors, the tailgate is securely closed and the minor is being transported either in the course and scope of employment or between a hunting camp and hunting site or between hunting sites during hunting season and the minor has a hunting license

Actually, there are laws restricting riding in the bed of a pickup in AZ. No person under the age of 18 is to be in the bed while the vehicle is in motion.

About 20 states have no law regarding riding in the back of a pickup truck, making it legal by default, and about 30 states have some form of restriction or law. Some states only allow persons 18 years of age or older to ride in the back of a pickup truck. Some states, such as California, it is almost completely illegal, with only a few narrow exceptions to the law. Check local laws before riding in the back of a pickup truck.

No, it is not illegal for anyone over the age of 12, however it is illegal in most cases for anyone under the age of 12.

The Tennessee 2007 Driver's Study Guide also points this out...

It is against the law to allow children under the age of 12 to ride in the bed of a pickup truck.

The only exceptions are:

1. When the vehicle is being used in an organized parade,

procession or other ceremonial event.

2. When the vehicle is being used for agricultural purposes.

3. For certain local areas where children over age six, but

not yet 12 years old, are in pickup trucks traveling on

local streets and roads. These road exceptions should be

checked locally.

Even with these exceptions, if a child under the age of six is in

the pickup truck bed, the vehicle must travel 20 miles per hour or less.

Delaware, Idaho, Illinois, Indiana, Iowa, Kentucky, Minnesota, Mississippi, Montana, New Hampshire, North Dakota, Oklahoma, South Dakota, Vermont, Washington, West Virginia, and Wyoming.

The remaining 30 states have laws primarily designed for the protection of children. Some of them extend to ages as old as 19, while a few prohibit any riding in the back. Probably the most lenient is Colorado's law, which allows back riding as long as the riders are seated and the area is enclosed on all four sides: sorry, but no hanging your feet off the tailgate. Most states restrict this based on age. The following states allow back riders older than age 18; Florida, Georgia, Maine (older than age 19), Michigan, Missouri, Nebraska, Nevada, New Mexico, Oregon, Pennsylvania, and Texas. Some states set age 16 as the cutoff point: Connecticut, Maryland, North Carolina, Ohio, Rhode Island, and Virginia. Other states have lower age limits: Kansas (14), Louisiana (12), Massachusetts (12), South Carolina (15), and Tennessee (12). These states prohibit back riding unless specific conditions are present: Arkansas, District of Columbia, New Jersey, Utah, and Wisconsin (work-related); Hawaii (no room in the passenger compartment); and New York (limited by length of trip and age of passengers.)

PASSENGERS IN AN OPEN-BED TRUCK

An open-bed pickup truck or open flatbed truck may not be driven at a speed of more than 35 mph, if any person

is occupying the bed of the truck. Such a truck may not be driven with a child under 18 years of age is occupying

the bed of the truck.

Exceptions to this law are:

• A child of a farmer, who is being transported between parts of a farm or farms owned or operated by the farmer

in order to perform work on the farm or farms.

• A child employed to perform farm labor, who is being transported between parts of a farm or farms owned or

operated by the child's employer or employers.

• A child possessing a valid hunting license, who is being transported between a hunting camp and a hunting site

or between hunting sites during hunting season.

• A child, who is a participant in an officially sanctioned parade, only during the course of the parade.

It is illegal to ride in the back of a pickup in Hawaii unless there is no room in the passenger section of the truck. There are also other restrictions pertaining to the action depending upon the area that is traveled.
