Well..yes and no...your question is weird:

If you didn't file the form...then the SOL never starts so it is always open.

If you did file and pay, as claimed...then you have no problem proving it anyway, so the question is almost moot, you don't need an SOL really. You just need to help them get the information together so that it will go away.

The simplest thing to do to put this behind you is to pay a visit to the office with your paid receipt and get the issue straightened
