It depends on what you mean by "unfair." If you can prove that the teacher is giving other students better grades when your work is the same quality, you can go to the principal and discuss what can be done about it. If you're actually doing something that is making the teacher treat you differently, however, you're not being treated unfairly.
Ask your guidance counselor or another teacher what they think about this teacher's behavior and see if it really is unfair or not.
