- Some people mean well and are overly sensitive to what they term as elder abuse. It is not uncommon for the elderly to have to wear diapers while sleeping or through the day. Generally during the night the elderly person could urinate or leave feces in their diaper and this is no different than a baby doing the same thing. The elderly lose muscle control and the bottom line is their bodies are breaking down. As long as the caregiver gives the elderly person the best care they can then they cannot be legally accused of being abusive. As long as you are seeing to the needs on a 24/7 basis (even if you have to get part-time care in); taking this elderly person to their doctor's appointments; being sure they get the best medical care; are fed properly; given their medications on time; bathe them one or more times a day with clean clothing or nightwear then this is not elderly abuse. It is not uncommon for someone who knows the elderly individual to accuse the caregiver of stealing certain things from that elderly person, but the accuser has to prove it. It would be wise if you saw a lawyer regarding this to protect yourself from these allegations.
