A writ of judgment is issued by a court after a debtor (defendant) has been sued and the plaintiff (creditor) has won the case. Credit card companies usually sell defaulted accounts to third party collectors. That agency attempts to collect the debt, by contacting the debtor. If satisfactory terms cannot be made, the collector has the option of procuring a collection attorney to file a lawsuit, and perhaps be granted a judgment. The writ of judgment is then executed against any nonexempt property that belongs to the debtor.
