A doula is an assistant who provides various forms of non-medical and non-midwifery support (physical and emotional) in the childbirth process. Based on a particular doula's training and background, the doula may offer support during prenatal care, during childbirth and/or during the postpartum period. A birth doula provides support during labor. Thus a labor doula may attend a home birth or might attend the parturient woman during labor at home and continue while in transport and then complete supporting the birth at a hospital or a birth center. A postpartum doula typically begins providing care in the home after the birth. If a woman signs an agreement to hire a doula birthing assistant with a nonrefundable deposit and has medical complications and can't use the doula can she get back her deposit?
You should do two things: 1. Read your doula contract carefully - it should state whether there are any exceptions to the status of your deposit. If it says the deposit is non-refundable under any circumstances, then you have your answer. If not, then... 2. Call your doula, explain what happened and ask her if you can get your deposit back. Be prepared to hear a "no", simply because you have signed a binding contract stating the deposit is non-refundable. Whether or not you can get your deposit depends on your doula, but usually "non-refundable" means just that. If your doula has already spent time answering your question during an interview and doing the prenatal visits, then she deserves compensation for her time, which is one of the reasons for the deposit. Another reason is that a typical doula will not schedule clients with due dates within one to two weeks of each other; as it's possible to have them both go into labor at about the same time. Since she was counting on having you as a client, she may have turned away other women, thus losing money. Having said all that, if the medical complication you are speaking of have caused a miscarriage, many doulas may return the deposit because they understand the intense emotional pain involved.
