normally (and many places have their own code for this) a chimney has to be at least 2 feet higher than any roof within 10 feet of the chimney

check your local building dept for code compliance

As a rule of thumb, the top of a masonry chimney should extend above the roof peak of the section of roof it is penetrating. That is only a generalisation. For a more definitive answer, contact your local planning and zoning office. There are formulas for determining stack height based on material, stack thickness, linings, roof pitch, and distance from the peak.

According to NFPA 211 (The national standard for fireplaces) Chimneys SHALL stand 3' above the roofline AND 2' above anything within 10' (This is the 3-2-10 rule)

3 feet above the roof and 2 feet higher than anything withing 10 feet. In New Zealand the requirement is at least 1m above the adjacent roof and 1m higher than anything within 3m.

chimney height is based on chimney exits it smoke and debris should 2 ft. taller than any structures within 10 ft diameter of that chimney
