The Fair Labor Standards Act of 1938 instituted the first nation-wide restrictions on the use of child labor.

Similar restrictions on child labor had previously been declared unconstitutional by the Supreme Court in Hammer v. Dagenhart(1918). Hammer was one of many attempts to regulate working conditions that were declared unconstitutional during the infamous 'Lochner era'.

Changing perspectives in the legal community regarding the 'freedom of contract' and the scope of Constitutional rights help to explain this shift in the views of the Supreme Court. Also during this time were larger social movements emphasizing workers' rights and the value of compulsory school attendance laws for children. These influenced the public debate on the issue, if not the Court directly.

Today, the Federal Laws on "child labor" regulate the time of day, day of week, and maximum hours a 'child' can work- which can vary depending on the age of the child, the time of year, and industry.
