Monday, February 1, 2010Employers are normally required to deliver or mail/postmark employee copies of W-2 forms by January 31, 2010. However, since the 31st falls on a Sunday in 2010, the IRS has made Monday, February 1 the deadline. You can request an extension.

Employer's "red ink" Copy A should be submitted to the IRS by February 28. But again, since this falls on a Sunday, the new due date is March 1, 2010.

There are penalties for filing late.

Note:

If the employer does not provide a W-2 to employees (perhaps they are no longer in business), an employee can file their own W-2 with the SSA to make sure they get credit for Social Security Benefits when they retire.

For 2008 W-2 forms, the deadline was February 2, 2009. For 2009 W-2 forms, the deadline is Monday, February 1, 2010.If you don't receive your W-2 form by the deadline, contact your employer. If you still haven't received your W-2 by mid-February, contact the IRS at 1-800-TAX-FORM(1-800-829-1040) to report this situation. If you have your last paystub, refer to it in filling out Form 4852(Substitute for Form W-2, Wage and Tax Statement) and attach it to your return.
