It all depends weather or not Tobi is Madera (i think he is) then he does have the Mangekyo sharingon, but if your one orf the "Tobito" belivers then he probably doesnt have it.

TRUTHTobi actually is not Madara, Madara is brought back to life in one of the newer episodes and fights for the Akatsuki. This proves that Tobi is an imposter.

∙ 14y agoHe can use Eternal Mangekyo Sharingan and has mastered the Sharingan to such an extent that he was the former leader of the Uchiha Clan. Because of his Eternal Mangekyo Sharingan which he gained from taking his younger brother's Mangekyo Sharingan and his own, he can teleport to anywhere he wants and teleport other people as well. It makes other people pass right through him as well, making him intangible. However, if he wants to attack, he must become solid. It is also very likely that he can use Tsukuyomi, Amaterasu, and Susanoo with his Eternal Mangekyo Sharingan.

Tobi is not Madara Uchiha. He is Obito Uchiha, whose right eye is his original Mangekyo Sharingan eye. His other eye is the eternal one, considering he can evolve it to the Rinnegan form, it's most likely to be one of Madara's.
