Your not very clear...the accident is something that will always have happened, and presumably you will be responsible for. Your driving record will reflect it. Your obligation for paying the damage, what your responsible for, may be handled as part of a BK, like most all debts your responsible for. The BK includes all your assets too though....you don't just get cancellation of debts and obligations, or those you want, and to keep your assets.

If the accident was not caused by drug or alcohol or deliberately, the judgment can be discharged in bankruptcy. You cannot file just for the judgment. ALL creditors must be listed, and you might have to do a chapter 13.

Yes, unless the driver was intoxicated at the time of the accident, which could be grounds to have the judgment ruled non-dischargable.
