Several factors can influence sentences...
He may have had some/more previous convictions,
The other may have pleaded guilty and your boyfriend not,
The other may have cooperated with the police,
The other may have been seen as an accessory, and not the main culprit.
A defendant attempts to develop a defense to a criminal charge so he can avoid getting convicted, jailed, and/or fined. Without a defense, a conviction would be inevitable.

It means you don't have to serve the sentence if you don't break the law within a given period. So no because you don't have to do it. if it was a conviction you'd have to do it or you'd die.

This depends on whether or not the person was convicted. If they weren't convicted, it is possible to get the crime expunged. If they pleaded or were found guilty, however, unless there are other extenuating circumstances, a robbery conviction can't be expunged. The only records that can be expunged after a defendant has plead or been found guilty are misdemeanors.
