Anti-Deficiency Act
The Anti-Deficiency Act is legislation enacted by the United States Congress to prevent the incurring of obligations or the making of expenditures (outlays) in excess of amounts available in appropriations or funds.
This Act of Congress is sometimes known as Section 3679 of the Revised Statutes, as amended.
Misuse of terminology
Among the governmental acquisition community, a widespred misnomer is that when a contract instrument is released with unavailable funds, the contract is "anti-deficient". However, the correct term is simply "deficiant", as the Act itself is an attempt to counter deficiencies.
