  • On the English-language Wikipedia ([1]), hosted on servers in the United States by the non-profit Wikimedia Foundation ([2]),

qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use and Wikipedia:Copyrights.

To the uploader: this tag is not a sufficient claim of fair use. You must also include the source of the work, all available copyright information, and a detailed fair use rationale.

SOURCE: This image is from the Colegio Cesar Chavez student catalogue. The entire catalogue is stored at the Oregon State University Multicultural Archives [3] where it is made available to any researcher interested in Colegio Cesar Chavez. Picture description: The above picture is a scan of a page out of Colegio Cesar Chavez's student catalogue for the year 1978. The picture on this catalogue page depicts students seated in Colegio Commons, in the building known as "Huelga Hall." To the right, above the head of the man seated in the chair, one can make out the mural of Che Guevara that was painted on the wall.

Fair Use rational:

1. Page from a booklet advertising Colegio Cesar Chavez, and therefore "fair use" seems obvious.

2. There are no substitute images available.

3. No photographer's name and no copyright information is provided in this booklet, therefore the likelihood of any copyright infringement is not likely.

4. Booklet is 1978 promotional material for an institution that went out of business over 20 years ago, in 1983. (Could the copyright have possibly expired completely?)
