depositions de bene esse conditional depositions which are nonusable if the witness is available at the trial.
evidence de bene esse refers to the doctrine of conditional relevancy, and stands for the situation where the admission of evidence is conditioned upon a subsequent showing of facts necessary to demonstrate valid admissibility. See 100 A. 2d 246, 252.
