Derivative Tort

An action in tort based on the criminal conduct of defendant which resulted in injury toplaintiff, and for which injury plaintiff seeks compensation. The action is distinct from any criminal prosecution which may result from the same conduct by defendant.

The term also applies to liability imposed on a principal for the wrongs committed by his agent. See vicarious liability.
