Easement By Prescription

Real Estate Dictionary: Easement By Prescription

Continued use of another's property for a special purpose can ripen into a permanent use if conditions are met.
Example: Although Abel can reach the highway by another path, for the last 10 years, Abel has been traveling across Baker's property to reach the highway. Since Abel has been doing this for the length of time required by state law, Abel can continue to do so despite Baker's protests, because Abel has achieved an easement by prescription .
