Hirābah (Arabic: حرابة‎) is an Arabic word for “piracy”, or “unlawful warfare”. Hirabah comes from the root hariba, which means “to become angry and enraged”. The noun harb (حرب, pl. hurub حروب) means “war” and/or “enemy.”[1] One who commits hirabah would be a hirabi.

Punishment for Hirabah

The Qur'an commands strict punishment for those who spread disorder in land.[2] As it is in the Qur'an:

The punishments of those who wage war against Allah and His Prophet and strive to spread disorder in the land are to execute them in an exemplary way or to crucify them or to amputate their hands and feet from opposite sides or to banish them from the land. Such is their disgrace in this world, and in the Hereafter theirs will be an awful doom. Save those who repent before you overpower them; you should know that Allah is Oft-Forgiving, Ever Merciful.

According to these verses, the punishment for spreading disorder in land is:

  1. Taqtil (تقتيل:execution that serves a severe warning to others i.e. stoning)
  2. Taslib (تصليب:Crucifixion)
  3. Amputating limbs from opposite sides
  4. Nafi (نفى:Exile)

A Judge can give any of these punishments depending on the severity of the crime and condition of the criminal. These punishments can be prescribed for any crime that can threaten the society at large. Examples of these crimes are robbery (unlike theft which has a different punishment), rape, and terrorism.[2]

And yet they cannot be given at all - if the above verse is clear - when the criminal repents before they are overcome. This would mean one who surrenders willingly to the police or one who surrenders on the battlefield cannot punished. You who would practice Islam must know that that your Lord is the Oft-Forgiving, Ever Merciful. And should the police decide to lie - such that they had to overcome him, as they more often than not do for the sake of the government or their commander, or their pride, then it is the absolute responsibility of the court to prove the case of the police, or the soldiers, and to rule if the person who stands accused is stopping their aggressive actions or intends to do so.

This verse is often used by the Tyranny in general to justify killings on the basis that some activity that is undesired consists of waging war against Allah Most High and His Prophets. This may be the case only for two kinds of sinners mentioned in the book: The crime of usury (which is waging war), and the crime of waging war itself - which may extend to acts of espionage and sedition (though not if such acts are not aimed against Allah or the Prophets, or are intended to help them - though if the defendant in this case me have to be convinced of the validity of their own government process and why it is not in fact a state at war with God - which is probably not the case, since we all in fix thanks to the Accursed). The act of war can also be extended to include acts of force against private persons that kill or maim - rape, dangerous armed robbery, personal assault with a weapon not in an act of defense, repeated acts of terrorizing the individual or groups of individuals -the person can surrender though and then face a reduced sentence. It costs too much money in some societies - but the trauma of violence seems to cost a lot more.

If Muslims seek to extend the tyranny of violence - they what of muslims do the be? The tyrannical kind, the kind who love their authorities, and do not question their authority by authority of God - in feeling, though, study, and in life. The ones who don't even seek the will of Allah in life? Who are these people - these traitors?

The usual attempt of the extremist is to label any kind of public sin "waging war" and therefore killing anyone they don't like. This is not the practice of Peace. These is the practice of Harb, and that makes such an extremist person a Haraba. They obstruct most millions of people from the Path to Allah, with their lying and tyranny. They love especially the practice of Ahaditha usury. Yes, mint that money Abbassid - make everyone use it - and you will control the world! You don't have even put usury on it - but you can - as long as its not the doubling increase - "But if in the book it says no doubling or increase - than how do you say" - No, those verses have been overruled - by our Ahadith! Now go back to your prison cell Mon! And well slap the interest on the entirety of society and keep minting/printing the bills - these scholars are too innumerate to figure out what's going on - except those Mathmeticians at Qom - get them! And the ones in Damascus. Kill that Malik! And bring me the of Abu Hanaf - no... they just won't go...

If they are in Peace with the Almighty, and simply at a different stage in their evolution. If the majority of muslim scholars want to be condemned to death - they can continue to obstruct God by changing his path to one of oppression and sin - and usury - by depriving people of their right to live with God and repent. Make progress.

Relation with Jihad

Hirabah has been suggested as a better description of a punishment than the often-used jihad which is often misconstrued as referring to religious terrorism. The argument is that jihad means literally "struggle". The meaning is broad, and can include personal, internal struggle to purify oneself as well as external struggle for justice.[1] By definition, Jihad cannot be a bad thing, as jihad means "to struggle in the way of God", or "to struggle to improve one's self and/or society". Therefore, someone who is misguidedly responsible for unlawful killing and chaos in the land can only be described as someone engaged in hirabah.
