If your child lived with you but you did not claim it as a dependent you can still file head of household. You have to list the child's name and social security number on your return.

Can 2 people claim head of house one has a child the other does not?

Not in this scenario. One dependent can only qualify one person for the head of household filing status. Even if there were 2 children, each person would have to be maintaining a household for one of the children to qualify. Example 1: Two roommates split the rent and other household expenses. Each has a child and takes care of the expenses for their child. Each can qualify as head of household assuming they meet all other requirements. Example 2: An unmarried couple has two children and live together. They live jointly and use their money jointly. They are not living as roommates. The person making the most money can qualify as head of household, because they would be maintaining more than half the costs of keeping up a home for a qualifying child. The other person qualifies as single. This is true regardless of who claims the children.

Can I go back and change the return I already filed my tax return claiming my son as my dependent but I've decided to let his father claim him because my son resided with his father last year?

Generally, yes. Form 1040X is Amended U.S. Individual Income Tax Return. To change the number of exemptions (personal and dependent) claimed on your original return, you fill out lines 25 to 32 in Part I-Exemptions on page 2 of Form 1040X.There is a special situation for a Qualifying Child of more than one person. You both can have a tax benefit. The noncustodial parent can claim an exemption and the Child Tax Credit for the child. The custodial parent can claim the child as a Qualifying Child for (1) Head of Household filing status, (2) Credit for Child and Dependent Care expenses, and (3) Earned Income Credit.

Can a father still claim his child on his income tax if the father is now in prison?

Generally, no because he would no longer be providing support for the child nor sharing a household, but there might be cases where the child would still qualify as a dependent for tax purposes. Usually someone else would qualify to claim the child instead.

Do you have to pay child support to your spouse if you never adopted her child?

not if your cold hearted This full depends on related circumstances. These usually apply when she has no idea who the father is, or at least claims that, and you've become a primary influence in the child's life. The drawback of this is that you can be prevented from getting custody or visitation rights, because you're not the father, while being obligated to pay child support. see link below
