Not without the consent of the non-custodial parent ! The other parent has a right to know who their child has been left with (and perhaps would take the child themselves as a better guardian).
Move with someone? Who is the someone? I am assuming its another person you are in a relationship with. I would say no you do not need custody in place if you and the child other parent are in good terms and no one parent rights are being violated. Custody battles are a headache.
