no it is not illegal. By law, they're both still in the age range, and are still in their teens. If the woman was 21, then the male could be arrested. It depends on the legal age of consent, in some states it's still 15, some 16, some 18. However, most states turn a blind eye to the written law as the above answer mentioned if both are teens. For example an 18-year old senior high school student dating a 16 year old. The above is wrong on who would get arrested though. Male wouldn't be arrested, if the woman was 21 and the male 16, the woman, as the offending adult, would be arrested. See the several teachers in FL that had sex with their students ( I was never so lucky).

It is illegal, but it is only a misdemeanor. I don't know whether or not you can go to jail for it, but if you did, it wouldn't be for a long time.

The age of consent in New York State is 17. The age of consent law for New York State reads: "Sex with a person under 17 is a misdemeanor if the perpetrator is at least 16." It's called "sexual misconduct."

It would be a felony if you were 21 or older: "Sex with a person under 17 is a Class E felony if the perpetrator is at least 21." That would be "rape in the third degree." It would also be a felony if the person you had sex with was under 15: "Sex with a person under 15 is a Class D violent felony if the perpetrator is at least 18." That is called "rape in the second degree."
