Not unless he wants to take the risk of getting into a lot of trouble for messing with a minor child. He is an adult at 16 you are still considered a minor unless of course you have spoken with your parents and they are OK with it, other wise not a good idea at all on his part that is taking a big risk.

As long as they do not have sex, there are no problems with them dating. Unless the parents have a problem with them being together...
